Just this week, we had duelling rulings on whether Texas has the power to arrest felons illegally crossing the border. Let’s hope the courts are watching the news.
Incentives matter.
When Trump set up a deal with Mexico that anyone crossing illegally would be forced to wait their turn for a hearing BEYOND the US border… illegal border entries slowed to their lowest numbers in years. Because the risks entailed in breaking the law to get here didn’t give the payoff to make it worth their while.
But ever since that 2019 debate where every Democrat candidate raised their hand to promise freebies to illegals, illegals were counting the days for a Dem to take his turn in the Oval Office. For once, Biden was as good as his word. Better even.
Illegal aliens are reportedly getting more monthly cash than Social Security beneficiaries who paid into a system for their entire lives. That’s Democrat logic for ya.
As a result, illegals have been pouring into the country, literally by the millions. And Biden has done everything he can to hold those floodgates open. Anything that would slow the flow became a high-priority legal battle — ranging from a shipping container wall in Arizona, to the Rio Grande buoys, to the razor wire standoff at Eagle Pass, and then Texas passing SB4 to enforce criminal trespassing laws on anyone entering the state at an unauthorized point of entry.
How the courts will rule on the Constitutionality of that ruling remains to be seen. But the legislation itself is anchored in an aspect of the State Constitution of Texas.
In the Governor’s own words:
“The Executive Branch of the United States has a constitutional duty to enforce federal laws protecting States, including immigration laws on the books right now,” reads the statement. “President Biden has instructed his agencies to ignore federal statutes that mandate the detention of illegal immigrants. The failure of the Biden Administration to fulfill the duties imposed by Article IV, § 4 has triggered Article I, § 10, Clause 3, which reserves to this State the right of self-defense. For these reasons, I have already declared an invasion under Article I, § 10, Clause 3 to invoke Texas’s constitutional authority to defend and protect itself. That authority is the supreme law of the land and supersedes any federal statutes to the contrary.”
The federal failure (or refusal!) to do it’s job triggered the State’s right to self-defense.
Texas responded to that federal failure by implementing SB4 into law. (Details of the law explained here.)

While the rest of us wait for the guys with the gavels to figure out what’s going on, the illegals waiting on the other side of the fence were getting impatient. If this law goes ahead before the can say Ally-Ally-Oxen-Free, they’re screwed and they know it.
And, since we already know that incentives matter, and the thing they want most is to be on the this side of the US/Mexico border while Biden is still making decisions, their situation was getting urgent.
What did they do? These supposedly peaceful ‘newcomers’ as Joe tried to tag them went out of their way to prove Governor Abbott’s ‘invasion’ claim about the illegal immigration was a correct understanding of what’s REALLY going on there.

The crowds breached the razor wire and were met with a more permanent unscalable fence.

If this isn’t already entered into evidence in the SB4 hearings… it should be soon.
How dangerous is this situation of migrants bum-rushing the border? The fact that the National Guard is not equipped with non-lethal armaments if things get dicey is a good place to start.
The Biden people claimed SB4 would ’cause chaos’.
If SB4 were in place, these same people would be facing a choice — right now — between deportation and incarceration. Period.
Maybe THAT has something to do with why Joe’s border security polls are as bad as they are.
